This Privacy Policy describes how VibelySpot (“VibelySpot”, “we”, “our”, or “us”) collects, uses, and discloses Personal Information when you use the VibelySpot mobile application (the “App”) and our website at vibelyspot.com (together, the “Services”).

We have written this policy to be clear and concise. By using the Services, you acknowledge that you have read and understood this policy. If you do not agree with any part of it, please do not use the Services.

1. Information We Collect

We collect Personal Information in three ways: information you provide to us, information collected automatically when you use the Services, and information we receive from third parties.

1.1 Information you provide

  • Account information. When you create an account using Sign in with Apple or Google Sign-In, we receive your name, email address, and a stable user identifier from the identity provider. If you choose Apple’s “Hide My Email” option, we only receive Apple’s private relay address.
  • User content. Social-media links you share with the App (for example, Instagram URLs), places you add manually, custom tags, notes, photos you upload, and any feedback you submit through the in-app support channel.
  • Subscription information. When you purchase a paid plan, we receive a receipt from the Apple App Store confirming your subscription tier and validity period. We do not see, receive, or store your payment card or billing address.

1.2 Information collected automatically

  • Location information. With your permission, we use your device’s location to find nearby places, sort results by distance, and show your position on the map. You can change or revoke this permission at any time in your device settings.
  • Device and usage data. App version, operating system, language preference, time zone, push notification token (only if you grant the notifications permission), crash logs, performance metrics, and basic feature-usage analytics.
  • Advertising identifier. If you grant App Tracking Transparency permission on iOS, we and our advertising partners may receive your device’s IDFA to support ad measurement and the delivery of more relevant ads to free-tier users. We do not access this identifier without your consent.
  • Log data. When you interact with the Services, our servers automatically record information such as your IP address, request timestamps, and the actions performed. We use this information for security, abuse prevention, and debugging.

1.3 Information from third parties

  • Identity providers. Sign in with Apple and Google Sign-In send us a verified email address and a stable user identifier so we can authenticate you. We do not receive your password.
  • Publicly available social-media content. When you share a link with the App, we fetch the publicly accessible content of that page (post caption, public images, business name) to extract place information. We do not access private accounts or content that requires you to be logged in.

2. How We Use Information

We use Personal Information for the following purposes:

  • To provide the Services. Authenticating you, parsing shared links into structured place information using machine-learning models, displaying maps, managing your saved places and lists, and delivering features such as recommendations and rewards.
  • To process subscriptions. Verifying your purchase with the Apple App Store and unlocking the corresponding tier.
  • To communicate with you. Sending transactional notifications (for example, when a saved link has finished parsing) and, if you opt in, occasional product updates.
  • To personalize your experience. Ranking nearby places and recommending content based on your saved places and stated preferences.
  • To show advertising. Displaying ads to free-tier users, subject to the consents required by your device’s operating system.
  • To improve the Services. Diagnosing crashes, monitoring performance, analyzing aggregated usage, and developing new features.
  • To protect the Services. Detecting and preventing fraud, abuse, security incidents, and violations of our terms.
  • To comply with law. Meeting legal, regulatory, or contractual obligations.
We do not sell your Personal Information, and we do not share Personal Information for cross-context behavioral advertising as those terms are defined under applicable law.

3. How We Share Information

We share Personal Information only with the limited categories of recipients described below, and only as needed to operate the Services or meet legal obligations.

3.1 Service providers

We use trusted vendors to operate the Services, including providers of cloud hosting and database infrastructure, authentication, push-notification delivery, AI and machine-learning model APIs used to parse the links you share, mapping and geocoding, public web-content extraction, customer support tooling, and website hosting. These providers process Personal Information only on our instructions and under contractual obligations to safeguard your data.

3.2 Advertising partners

For free-tier users, we work with ad-network partners to serve ads inside the App. These partners may process device identifiers and limited interaction data to measure ad performance and serve more relevant ads. On iOS, they only receive your advertising identifier if you have granted App Tracking Transparency permission.

3.3 Identity and payment providers

Authentication is handled by your identity provider (Sign in with Apple or Google Sign-In). Subscriptions are billed and verified through the Apple App Store. We do not control these third parties’ data practices; please review their privacy policies for details.

3.4 Legal, safety, and compliance

We may disclose Personal Information when we believe in good faith that disclosure is necessary to comply with a law, regulation, legal process, or governmental request; to enforce our terms; to detect, prevent, or address fraud, security, or technical issues; or to protect the rights, property, or safety of VibelySpot, our users, or others.

3.5 Business transactions

If VibelySpot is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, Personal Information may be transferred as part of that transaction. We will notify you (for example, via the App or our website) before your Personal Information becomes subject to a different privacy policy.

4. Your Choices and Controls

  • Permissions. You can grant, deny, or revoke permissions for location, photos, camera, notifications, and tracking at any time in your device settings.
  • Notifications. You can turn off push notifications in your device settings or unsubscribe from product emails using the link provided in those emails.
  • Subscription management. You can manage or cancel subscriptions at any time in your Apple ID Account » Subscriptions. Cancelling stops auto-renewal but does not refund the current billing period unless required by law.
  • Account deletion. You can delete your account at any time from the App at Settings » Account » Delete Account.

5. Your Rights

Depending on where you live, you may have the right to:

  • Access the Personal Information we hold about you;
  • Correct inaccurate or incomplete Personal Information;
  • Delete your Personal Information (“right to be forgotten”);
  • Restrict or object to certain processing;
  • Receive your Personal Information in a portable, machine-readable format;
  • Withdraw consent at any time, without affecting the lawfulness of earlier processing.

6. International Data Transfers

We operate globally. Personal Information may be transferred to, stored in, and processed in countries other than your country of residence, including the United States, Taiwan, and other jurisdictions where our service providers operate. Where required by law, we rely on appropriate safeguards such as standard contractual clauses to protect cross-border transfers.

7. Data Retention

We retain Personal Information for as long as your account is active or as needed to provide the Services. When you delete your account, we will delete or anonymize your Personal Information within thirty (30) days, except where retention is required to comply with law, resolve disputes, prevent fraud, or enforce our agreements (for example, transaction records related to subscriptions are retained for the period required by applicable tax or consumer-protection laws).

8. Security

We use industry-standard safeguards designed to protect Personal Information, including TLS encryption in transit, encryption of data at rest, role-based access controls, secrets management, audit logging, and routine security review. No method of transmission or storage is 100% secure; we continually work to improve our protections, but we cannot guarantee absolute security.

9. Children’s Privacy

The Services are not directed to children under the age of 13 (or the equivalent minimum age in your jurisdiction), and we do not knowingly collect Personal Information from such children. If we learn that we have collected Personal Information from a child under the applicable age without parental consent, we will delete it. 10. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in the Services, applicable law, or our practices. When we make material changes, we will notify you through the App, by email, or by other reasonable means before the changes take effect. The “Last Updated” date at the top of this policy indicates the date of the most recent revision. Your continued use of the Services after the updated policy becomes effective constitutes acceptance of the revised policy.

11. Region-Specific Disclosures

11.1 European Economic Area, United Kingdom, and Switzerland (GDPR)

If you are located in the EEA, the UK, or Switzerland, our legal bases for processing Personal Information are: (a) Performance of a contract — to provide and maintain the Services you request; (b) Legitimate interests — to operate, improve, and secure the Services, provided those interests are not overridden by your rights; (c) Consent — where required, for example for marketing communications and for use of your advertising identifier; and (d) Legal obligations — to comply with applicable law. You may withdraw consent at any time without affecting prior processing.

11.2 California (CCPA / CPRA)

If you are a California resident, you have the right to know what categories of Personal Information we collect, to request access or deletion, to correct inaccurate information, and to opt-out of any “sale” or “sharing” of Personal Information for cross-context behavioral advertising. We do not sell Personal Information, and we do not share Personal Information for cross-context behavioral advertising as those terms are defined under the CCPA / CPRA. You will not be discriminated against for exercising any of these rights.

11.3 Taiwan

If you are located in Taiwan, you may exercise rights under the Personal Data Protection Act, including the right to review, obtain a copy of, supplement or correct, request collection or processing cease, and request deletion of your Personal Information. 1.2 系統自動蒐集的資料

  • 裝置與使用資料:App 版本、作業系統、語言、時區、推播 token(僅在您授權後)、當機紀錄、 效能資料,以及功能使用的基本分析資料。

  • 處理訂閱:向 Apple App Store 驗證您的購買並開通對應方案。
  • 與您溝通:傳送交易型通知(例如解析完成),以及您同意接收的產品更新訊息。
  • 個人化體驗:根據您的收藏與偏好提供附近地點排序與內容推薦。
  • 顯示廣告:對免費版使用者顯示廣告,並遵循作業系統要求的同意機制。
  • 改善服務:排查當機、監控效能、彙整使用分析、開發新功能。
  • 保護服務:偵測與防止詐欺、濫用、資安事件及違反條款行為。
  • 遵循法律義務:滿足適用法律、法規或契約要求。

3. 我們如何分享資料

我們僅在下列有限類別的對象範圍內、且僅在為提供本服務或履行法律義務所必要時,方分享您的個人資料。

3.1 服務供應商

我們委由受信任的供應商代為運作本服務,包括雲端代管與資料庫基礎設施、身分驗證、推播傳遞、用於解析您所 分享連結的 AI 與機器學習模型 API、地圖與地理編碼、公開網頁內容擷取、客服工具、以及網站代管等。這些 供應商僅得依我們的指示處理個人資料,並受契約義務保護您的資料。

3.2 廣告夥伴

對免費版使用者,我們會與廣告網路夥伴合作以投放 App 內廣告。此等夥伴可能會處理裝置識別碼及有限的互動資料,以衡量廣告成效並提供更相關的廣告。於 iOS 上,僅在您授權「App 追蹤透明度」後,廣告夥伴方能取得您的廣告識別碼。

3.3 身分驗證與付款服務

4. 您的選擇與控制

  • 權限管理:您可隨時於裝置設定中授予、拒絕或撤回位置、相片、相機、通知及追蹤等權限。
  • 通知設定:您可於裝置設定中關閉推播通知;亦可透過行銷郵件提供的退訂連結退訂。
  • 訂閱管理:您可隨時於 Apple ID 帳戶 » 訂閱項目中管理或取消訂閱。取消僅停止自動續訂,除法律另有規定外不退還當期費用。
  • 刪除帳號:您可隨時於 App 內 設定 » 帳號 » 刪除帳號 刪除您的帳號。

5. 您的權利

視您所在地區而定,您可能享有下列權利:

  • 查閱我們所持有關於您的個人資料;
  • 更正不正確或不完整的個人資料;
  • 刪除您的個人資料(「被遺忘權」);
  • 限制或反對特定處理活動;
  • 以可攜式、機器可讀格式取得您的個人資料;
  • 隨時撤回同意(不影響撤回前處理之合法性)。

6. 國際資料傳輸

7. 資料保存

在您的帳號維持有效期間或為提供本服務之必要期間,我們會保存您的個人資料。若您刪除帳號,我們將於 30 天內刪除或匿名化您的個人資料,但法律要求保留者(例如與訂閱相關之交易紀錄須依適用稅法或消保法保存期限 保留)除外。

8. 資料安全

我們採用業界標準的安全防護措施,包括傳輸層 TLS 加密、靜態資料加密、權限角色控管、機密管理、稽核日誌與定期安全檢視。沒有任何傳輸或儲存方式可百分之百 保證安全;我們會持續強化保護,但無法絕對保證資料安全。

9. 兒童隱私
